Privacy Policy — Track Settings

This Privacy Policy explains how Snap Motorsports, registered in the Netherlands with its registered office at Reflectiestraat 43, 2631 RV, Nootdorp ("Snap Motorsports", "we", "us"), processes personal data in connection with the Track Settings mobile application (the "App").
Snap Motorsports is the data controller (verwerkingsverantwoordelijke) within the meaning of the General Data Protection Regulation (EU) 2016/679 ("GDPR") for the processing described in this policy.

1. What Data We Process
Depending on how you use the App, we may process the following categories of personal data:
a) Account data (if the App uses accounts)
Name or username, email address, password (stored in hashed form). Legal basis: performance of a contract (Art. 6(1)(b) GDPR).
b) Vehicle and setup data
Vehicle details (make, model, chassis/setup identifiers), suspension setup values, alignment values, tyre pressures, spring rates, damper settings, notes, and session information (track name, date, conditions) that you enter into the App. This data is generally not personal data unless it can be linked to you (e.g. via an account). Legal basis: performance of a contract (Art. 6(1)(b) GDPR).
c) Location and telemetry data (if you use timing/GPS features)
GPS position, speed, lap and sector times, and related telemetry recorded during sessions. Location data is only collected when you actively start a session and have granted the App location permission in iOS. You can withdraw this permission at any time in your device settings. Legal basis: performance of a contract (Art. 6(1)(b) GDPR) and, where required, consent (Art. 6(1)(a) GDPR) given via the iOS permission dialog.
d) Device and diagnostic data
Device model, iOS version, app version, crash logs, and performance data. Legal basis: legitimate interest (Art. 6(1)(f) GDPR) in maintaining and improving the App. (If you use Apple's crash reporting, this data is shared with us by Apple only if the user has opted in to sharing analytics with developers.)
e) Support communications
The content of emails or messages you send us, and your contact details. Legal basis: legitimate interest (Art. 6(1)(f) GDPR) in handling your request.
f) Purchase data (if the App offers subscriptions or in-app purchases)
Purchases are processed entirely by Apple. We do not receive your payment details. We may receive anonymised transaction and subscription-status information from Apple to activate features. Legal basis: performance of a contract (Art. 6(1)(b) GDPR).
g) AI chat data (if you use “Ask an Engineer”)
Questions you submit and any car or session data you choose to attach are processed to generate a response. Legal basis: performance of a contract (Art. 6(1)(b) GDPR).
We do not process special categories of personal data (Art. 9 GDPR) and we do not use automated decision-making or profiling that produces legal or similarly significant effects.
2. Where Your Data Is Stored
Setup, session, telemetry, account, and chat data is stored on servers operated by Amazon Web Services (AWS) located in the European Union (Frankfurt, eu-central-1). We use this provider as a processor under a data processing agreement compliant with Art. 28 GDPR.
3. Who We Share Data With
We do not sell personal data. We share personal data only with:
- Processors that help us operate the App, bound by data processing agreements: Amazon Web Services (hosting, authentication, and AI inference via Amazon Bedrock) and Anthropic (AI model provider via Amazon Bedrock);
- Apple, in connection with App distribution, in-app purchases, WeatherKit weather data, and (if enabled) iCloud sync, under Apple's own terms;
- Authorities, where we are legally required to do so.
4. International Transfers
Where personal data is transferred outside the European Economic Area (for example, to a provider in the United States), we ensure appropriate safeguards under Chapter V GDPR, such as an adequacy decision (including the EU–US Data Privacy Framework where the provider is certified) or the European Commission's Standard Contractual Clauses. 5. Retention
- Account data: retained while your account is active and deleted within 30 days after account deletion.
- Setup, session, telemetry, and chat data: retained until you delete it in the App or delete your account.
- Crash and diagnostic data: retained for a maximum of 12 months.
- Support communications: retained for a maximum of 24 months after the request is closed.
- Data we must keep under Dutch tax law (e.g. records relating to paid transactions): 7 years.
6. Your Rights
Under the GDPR you have the right to:
- access the personal data we hold about you (Art. 15);
- rectification of inaccurate data (Art. 16);
- erasure ("right to be forgotten", Art. 17);
- restriction of processing (Art. 18);
- data portability (Art. 20);
- object to processing based on legitimate interest (Art. 21);
- withdraw consent at any time, without affecting the lawfulness of processing before withdrawal (Art. 7(3)).
To exercise these rights, contact us at info@tracksettings.com. We will respond within one month. We may ask you to verify your identity before acting on a request.
You also have the right to lodge a complaint with the Dutch supervisory authority, the Autoriteit Persoonsgegevens (www.autoriteitpersoonsgegevens.nl), or with the supervisory authority in your own EU member state.
7. Security
We take appropriate technical and organisational measures to protect personal data against loss, misuse, and unauthorised access, including encryption in transit (TLS), access controls, and — where applicable — encryption at rest. No system is completely secure; if a data breach occurs that is likely to result in a risk to your rights and freedoms, we will notify the Autoriteit Persoonsgegevens and, where required, affected users in accordance with Arts. 33–34 GDPR.
8. Children
The App is not directed at children under 16. We do not knowingly collect personal data from children under 16. If you believe a child has provided us with personal data, contact us at info@tracksettings.com and we will delete it.
9. iOS Permissions
The App may request the following iOS permissions. Each is optional and can be revoked at any time in Settings:
- Location (While Using / Precise): required only for GPS timing and telemetry recording during sessions.
- Notifications (if applicable): session reminders or updates.
Denying a permission only disables the related feature; the rest of the App remains usable.
10. Analytics and Tracking
We do not use third-party analytics or advertising SDKs, and we do not track you across apps or websites owned by other companies. The App's Apple "App Privacy" label reflects this.
We do not show third-party advertising in the App.
11. Changes to This Policy
We may update this Privacy Policy from time to time, for example when the App gains new features. The current version is always available at https://tracksettings.com/privacy.html and within the App. For material changes we will inform you via the App.
